CPECC MARCH 1998 - DECEMBER 1999

(CHINA PETROLEUM, BEIJING)

Lead Claims Consultant

Middle East EPC contract, worth US $500million, for two gathering centres and approx. 280 kms of pipelines. Engineering and procurement executed in Beijing and construction work in the Gulf.

Engaged to evaluate the validity and legitimacy of a potential claim against their Middle East client, CPECC, upon receipt of the report, requested that the claim proceed on the condition that I led and directed the team of consultants.

A team of ex-pat., multidiscipline specialists was mobilised to Beijing and established no less than three hundred 'heads of claim' with a value of some US $ 250million. Claim format, structure, parameters and techniques for the claim were developed such that any request would be suitable, in the event of rejection, to withstand the scrutiny of arbitration. Every request for claim was to be based solely upon legitimate contractual grounds.

The first formal requests for variation, (value approx. US $ 64million), were developed in Beijing and the team were relocated to site, in mid December.

The contractor has severe liquidity problems and the claims work has been shelved for the foreseeable future.
